Delhi high court issues notice to Khurana

The Delhi high court on Tuesday issued a notice to former chief minister and Bharatiya Janata Party vice-president Madan Lal Khurana in the Rs 650 million hawala case.

Justice Jaspal Singh issued the notice following the Central Bureau of Investigation's petition challenging the designated court's verdict discharging the BJP leader in the case. The court also issued notices to the three Jain brothers and one of their employees and adjourned the case to November 10.

Senior counsel K K Sood accepted the notice on Khurana's behalf while A Jain accepted the notices on behalf of the Jains.

''Before deciding the matter, the main point before the court is the admissibility of the Jain diaries as evidence,'' said the judge. ''I am informed that a special leave petition is pending in the Supreme Court in the L K Advani case and is fixed for October 21. Both the sides have expressed their views on the matter and I should wait for the judgment on the SLP.''

Advani was discharged by the Delhi high court holding that the Jain diaries cannot be considered an admissible evidence.

Several other accused in the case were later freed on the same basis of the designated court judgment.
