CBI moves Delhi high court against discharge of Khurana
The Central Bureau of Investigation on Wednesday approached
the Delhi high court against discharging former Delhi chief
minister and Bharatiya Janata Party leader Madan Lal Khurana and
four Jains by the designated court in the Rs 650 million hawala case.
The CBI sought quashing of Special Judge V B Gupta's ''erroneous'' order
discharging Khurana, Surendra Kumar Jain, J K Jain, Balwant Rai Jain
and N K Jain in the case.
The CBI had charged Khurana of receiving Rs 300,000 from the
Jains as illegal gratification while holding public office in
1991.
Judge Gupta in his order had discharged Khurana and others on
the ground that the material sought to be relied upon by the prosecution cannot be converted into legal evidence.
In its petition, the CBI has contended that there
is abundant material which prima facie established that the accused were involved in a criminal conspiracy to pay and accept
bribes.
The dairy and file seized from J K Jain's home on May 3, 1991,
indicates payment of Rs 300,000 to Khurana, the petition said.
In addition, the CBI alleged it has been established during the course of
investigation that Khurana and S K Jain were closely
associated with each other.
