NHRC issues notice to Gujarat police
on Samir Khan encounter

Considering reports of some 'disturbing circumstances' with regard to the killing of Samir Khan Pathan, nabbed for allegedly plotting the assassination of Deputy Prime Minister Lal Kishenchand Advani, the National Human Rights Commission on Monday sought from the Gujarat police details of the procedure followed in the case.

Taking up the matter at a meeting of the full commission headed by J S Verma, the NHRC gave the police two weeks to reply.

It said the reply should clearly mention whether the procedure adopted is in accordance with the NHRC guidelines issued for the purpose.

"It is to ensure a fair inquiry into all such killings and to also ensure thereby compliance with the rule of law that the NHRC has issued guidelines requiring the procedure to be followed in such cases before reaching the conclusion that the killing was justified under the law and it was not the result of a fake encounter or death caused by custodial violence."

"It is, therefore, necessary for the commission to examine the death so reported in that light," the commission order said.

Pathan, who the police accused of plotting to eliminate Advani and Gujarat Chief Minister Narendra Modi, was killed on October 22 in an encounter in Usmanpura area in Ahmedabad.
