Go to jail first, then apply for bail: Patna HC tells ex-minister

The Patna high court on Monday took exception to former Bihar minister Ramashray Sahni resting in a government hospital instead of being in the jail after being sentenced to life imprisonment in a murder case.

A division bench, comprising justice S N Jha and justice T P Singh, directed that he first go to jail and then apply for bail.

The bench adjourned the hearing on a bail petition for August five after Sahni's counsel P N Pandey sought time to present before the court the certificate that Sahni was in judicial custody.

Sahni, a former minister for animal husbandry in the Rabri Devi ministry, along with 11 others was sentenced to life imprisonment for the murder of havildar Kameshwar Choudhary of Bhangrupur village under Samastipur police station on May nine, 1982.

He had been admitted to the Samastipur Sadar hospital on the recommendation of the Samastipur jail superintendent after he complained of chest pain and breathlessness.
