New Zealand, who won the toss and chose to bat, recovered from a poor start to amass 215 in 43.1 overs, with Craig McMillan hitting a half-century.
Pathan took three for 34, while Ashish Nehra (centre) claimed two for 22.
Both bowlers straightened the ball sharply off the seam and obtained swing through the air. They shared the new ball and reduced New Zealand to 36 for five by the 13th over.
Nehra had Stephen Fleming caught behind by wicketkeeper M S Dhoni for one, and trapped Nathan Astle in front for five.
