Judicial custody for Rastogi in FERA case

Ravinder Rastogi, deported from Dubai to face trial in a CBI case, was on Wednesday produced in a Delhi court in connection with the $1.5 million FERA violation case and was remanded to judicial custody till April 23.

Additional Chief Metropolitan Magistrate V K Maheshwari also issued summons to his brother Shubash Rastogi, who is a co-accused in the case, to appear before the court.

Enforcement Directorate had filed a complaint against the Rastogi brothers accusing that as partners of Delhi-based N D International they had exported goods worth $1.5 million from India in 1991.

However, the payment for the consignment was not received in India, thereby causing loss to the exchequer.

ED's counsel Naveen Matta had submitted that the accused were given time to produce proof of any special permission granted by the Reserve Bank of India in respect to the exports but the brothers had not done so.

Their act amounted to violation of the provisions of Foreign Exchange Regulation Act, he added.

The Directorate has also filed another complaint against Ravinder Rastogi for the alleged violation of FERA as a proprietor of Shanti Associates.

ED has accused Rastogi of exporting goods to the tune of $5.4 million from India in violation of FERA.

The court will record the pre-charge evidence in the case on April 23.

Ravindra Rastogi was arrested on an Interpol Red Corner warrant and was brought to Mumbai on February 12 to face trial in the Rs 171 crore (Rs 1.71 billion) duty drawback scam registered by the Central Bureau of Investigation.
