The decision on anticipatory bail plea of a police inspector accused of raping a minor was put off till Wednesday with a judge transferring the case to another court without assigning any reason.
Arguments were heard afresh by the new judge who reserved orders until Wednesday after the prosecution sought Arun Borude's custody saying that the inspector after indulging in "immoral activities, is now defying the law by refusing to appear before the court".
Borude, who is on the run after he along with three others was accused of raping a 15-year-old girl several times between February and March this year in a flat in Emerald Court building in suburban Powai, had filed a petition seeking anticipatory bail.
Principal Judge M L Tahalayani, who was expected to give an order on Borude's bail plea on Tuesday, transferred the matter to the court of Additional Sessions Judge R G Awachat. No reason was given
The court, however, decided to hear the case in Borude's absence. Borude's lawyer, Vaibhav Bhagade, told the court that his client is being "falsely implicated in the case". Pradhan, however, opposed the plea stating that his custodial interrogation was required at the earliest as the investigation was at a crucial stage.
"This particular accused does not deserve protection. Putting him behind bars is a necessity. After indulging in immoral activities, Borude is now defying the law by refusing to appear before the court," Pradhan argued. The rape incident came to light when the victim gave birth to a baby girl last week in a suburban hospital.
