HC adjourns hearing on petition challenging probe against Modi

The Gujarat High Court on Wednesday adjourned hearing on a petition challenging the probe by Supreme Court appointed Special Investigation Team into Chief Minister Narendra Modi and 62 others' alleged involvement in 2002 post-Godhra riots till July 17.

The petition was filed by former Bharatiya Janata Party Member of Legislative Assembly from Lunavada Kalubai Malivad challenging the probe by SIT with regard to a complaint made by Zakia Jaffrey, wife of slain Congress MP Ehsaan Jaffery, in which she has alleged that Modi, his cabinet colleagues, police officials and senior bureaucrats aided and abetted post-Godhra riots of 2002.

Jaffrey was killed during the 2002 riots in Gulburg society along with 39 others. The matter came up for hearing on Wednesday in the court of Justice D H Waghela when lawyer representing SIT Ajay Choksi asked for time till July 27 as a senior counsel K G Menon would be appearing in the case on their behalf.

When asked by the court why they wanted adjournment till July 27, Choski said that they wanted period till July 17, but the date was not convenient to the petitioner.

Justice Waghela told lawyers that the court will not function as per convenience of the senior counsels and scheduled the matter on July 17.

Earlier, Justice H N Devani of the high court has declined from hearing the case due to personal reasons.
