Gandhy interrogated in presence of lawyer

Following a court directive, top Maoist leader Kobad Ghandy was interrogated this evening in the presence of his lawyer at the special cell police station in New Delhi.

Vishal Gosain, lawyer of the top Communist Party of India (Maoist) Polit Bureau member, reached the special cell police station on Tuesday evening and met him, sources said.

However, there was confusion in the morning as Ghandy's lawyer sent one of his juniors to be present during the interrogation, sources said.

The junior lawyer could not meet Gandhy after the police said his name was not in the court order, they said.

Later in the evening, Gosain himself went to the police station and met the Maoist leader.

Chief Metropolitan Magistrate Kaveri Baweja had on Monday allowed Ghandy's plea seeking the presence of his lawyer during his custody interrogation.

Baweja allowed the application on the condition that the counsel shall not cause any interference in the process of interrogation. The counsel shall remain present at the visual distance only which would be decided by the investigation officer, she had said in her order.

Gosain had given an undertaking that he shall remain only at a distance from the accused during the course of interrogation and cause no disturbance of any nature.

Ghandy, who was arrested on September 20, is under police custody till October 15.
