A businessman has moved the Bombay high court seeking a direction to remove offensive content against Islam posted on YouTube. The division bench comprising Justices Abhay Oka and Sadhana Jhadav ordered that the matter be treated as a Public Interest Litigation and ordered it be posted before the chief justice.
Ameen Mustafa Idrisi, 30, states that the material hurts the basic faith of Islam and also the people.
The video titled 'Innocence of Muslims' is 'offensive'. He states that there is a malafide behind the video and also its circulation on the internet.
The petitioner states that he has tried to address the issue before the law agencies but has not got any reply till date. "I am hurt by this video. Many people from my religion are hurt," the petitioner has submitted.
As per provisions of the Indian Penal Code under section 295 A, 298, 505, 153 the accused can be punished for this. In addition to this, the Indian IT Act of 2000 states that these are cognisable offences punishable under 66-A and 67-A.
The petitioner sought a direction that the offending material be removed from the web immediately.
