High court order against felling trees

The Delhi high court has restrained the Municipal Corporation of Delhi from felling trees in one of the 'green belts' in south-west Delhi and directed the authorities concerned to maintain and preserve it as protected forest area.

A division bench, comprising Justices Y K Sabharwal and A K Srivastava, recently pronounced the judgment on a petition filed by the Indian Council of Legal Aid. The writ plea urged that 'Muradabad Pahari' should be maintained as protected forest area.

However, the bench allowed MCD to construct a temporary public convenience complex in the area without felling of the trees and disturbing the nature of the protected forest area.

The bench passed the order after taking cognizance of the September 23 affidavit filed by Delhi Development Authority Director B D Ram. He said the petitioner's claim that the DDA was not preserving the land was incorrect.

He further said the MCD was given permission by the DDA's land department for constructing the complex, but the former was not permitted to sink tubewells in the area as it would have required axing of trees.
