MHA hearing on Nirbhaya convicts after hanging!

News coming in now is that the Supreme Court will hear on March 23, the Centre's appeal against the High Court order on simultaneous execution of death row convicts. Supreme Court says it will hear on March 23, Home Ministry's appeal which sought directions to hang Nirbhaya case convicts separately.
The original date for hanging the Nirbhaya case convicts was January 22 which was later shifted to February 1, then to March 3 and now March 20.
The Supreme Court Thursday said it would hear on March 23 the appeal filed by the Centre challenging the Delhi High Court order that the four death row convicts in the Nirbhaya gang rape and murder case have to be executed simultaneously.
Solicitor General Tushar Mehta told the bench, headed by Justice R Banumathi, that the trial court has fixed March 20 as date of execution of the four convicts who have exhausted all their legal remedies.
Mehta told the bench, also comprising Justices Ashok Bhushan and a S Bopanna, that these convicts have made a mockery of the system by their delaying tactics and taken it for a ride.
The bench said that it would hear the mater on merits on March 23 and made it clear that no adjournments will be granted.
Convicts in a common crime case cannot be hanged separately. A 1982 judgment of the Supreme Court says that the convicts cannot be hanged until all the persons on death row have exhausted all legal remedies.
In the Nirbhaya case, the President has rejected the mercy petition of all four convicts. In the case of one of the convicts -- Pawan Gupta. President Ram Nath Kovind had on Monday, had rejected his mercy plea. This means as per law, Pawan Gupta cannot be hanged before expiry of 14 days since the rejection of the mercy plea by the President. Pawan's mercy plea was rejected yesterday, March 4th.
