The juvenile court in New Delhi Thursday ordered the Delhi police to register a first information report against four of its personnel for allegedly subjecting four minor boys to sexual abuse of the "most disgusting kind" inside the lock-up to extract a confession.
The shocking incident, which took place in the Usmanpur police station, came to light when the boys, aged between 11 and 15, sought permission to make certain submissions when they were produced before Juvenile Justice Board Principal Magistrate Santosh Snehi Mann in a murder case.
"The allegations made by the delinquents against the police officials are of very serious nature. The revelations are of most disgusting nature as well as shocking to any human conscience," the magistrate said ordering the station house officer to identify the culprits through a test identification parade and lodge an FIR against them immediately.
In the statements Wednesday, the boys, who were on bail, alleged they were picked up from their house on the pretext that they were wanted for interrogation and were severely beaten up inside the lock-up.
The juveniles said after "forcing them to indulge in sexual act with each other", the policemen subjected them to "unnatural acts" for their own pleasure and told them they will be let free only if they confess to the murder.
The boys alleged that the cops, who also included the investigating officer of the murder case, "urinated on their face".
The magistrate said on the basis of the allegations, offences under Section 342 (wrongful confinement), 348 (confinement to extract confession), 355 (assault to dishonour a person), 367 (kidnapping to subject to unnatural lust) and 294 (obscene acts) "appear to have been made out".
To ensure an impartial probe, the court also directed the area deputy commissioner of police to transfer the investigation of the case to any independent investigating agency.
"Since the allegations are made by the delinquents against the investigating officer of this case and other police personnel of Usmanpur police station, it would be expedient in the interest of jusice and fair investigation that the matter be probed by an independent agency," the magistrate said.
The magistrate has asked the police to file a compliance report on December 5, the next date of hearing.
