The move by police to drop charges under Prevention of Terrorism Ordinance against suspected Al Qaeda terrorist Mohammed Afroz Abdul Razak and two others was on Wednesday stalled by a special court, which ordered the investigating agency to have a fresh look and file a charge sheet by April 9.
Designated judge A P Bhangale ordered the investigating agency to fully apply its mind on the applicability of Prevention of Terrorism Act or Maharashtra Control of Organised Crime Act or any other law in the case of Afroz, his absconding brother Farooq and foreign-based uncle Mubarak Musalman.
The judge informed Afroz that he had a right to get bail in view of the police dropping charge against him under POTO.
The accused, however, waived his right to seek bail as he was undergoing meditation course in jail.
Afroz said that he would seek bail only after March 30. The court said application of POTA or MCOCA was under its consideration and would be decided only after the police files charge sheet.
The judge suggested police to consider whether this case fell under POTA or MCOCA in view of series offences such as promotion of insurgency committed by the accused.
