CBI court reserves order on Laloo's petition

The Central Bureau of Investigation court Thursday reserved its order on the petitions filed by former Bihar chief ministers Laloo Prasad Yadav and Dr Jagannath Mishra challenging its jurisdiction over issuing non-bailable warrants against them.

CBI special judge Asit Baran Sarkar reserved his order till May 15 after hearing the CBI defending the filing of the charge-sheet in the designated court in the RC 47(a) case.

The CBI said the RC 47(a) case, which deals with the fraudulent withdrawal of money from the state treasuries, was different from the other 36 cases which were in the trial stage and refused transfer to Jharkhand by the Patna High Court.

The counsels of Yadav and Mishra pleaded for the staying of the non-bailable warrants saying the designated CBI court had no jurisdiction over the cases as they had not been transferred to Jharkhand.

They said the warrants should be stayed to enable them to move the high court.

The non-bailable warrants were issued by the designated CBI court on May 8 taking cognisance of a charge-sheet filed by the CBI against 110 accused including eight who are dead, in the Rc 47(a) case of the fodder scam.

The court had issued non-bailable warrants against 33, including two former chief ministers and former state minister Chandradev Prasad Verma. Summons had been issued against 77 others by the court.

The court in its orders had directed the Director General of Police, Bihar to execute the arrest warrants against Yadav, Dr Mishra and Verma as the court would take up the hearing of the charge-sheet on May 22.

The DGP was ordered to execute the warrants by the court on a request made by the CBI apprehending law and order problems while the CBI is to execute the warrants of arrest against the remaining 30 against whom non-bailable warrants had been issued.

Sources said the CBI has initiated steps for the execution of the warrants soon after their receipt on Wednesday while the DGP Bihar claimed that till Wednesday evening arrest warrants against Yadav, Dr Mishra and Verma had not been handed over.
