Charges framed against 16 in Uphaar case

A Delhi court on Tuesday ordered framing of charges against 16 accused, including cinema hall owners Sushil Ansal and Gopal Ansal, in the Uphaar fire tragedy case which claimed 59 lives in Delhi in June 1997 during the screening of Hindi blockbuster Border .

Additional Sessions Judge Mamta Sehgal, who pronounced the order in a jam-packed court room, fixed April nine to read out the charges to each accused and ask if they would plead guilty or prefer to stand trial.

Besides brothers Sushil and Gopal Ansal, the court ordered framing of charges against five others - PWD official S N Dandona, Municipal Corporation of Delhi officials Shyam Sundar Sharma and N D Tiwari, Delhi Fire Service officials H S Panwar and Surinder Dutt under Section 304-A (causing death by negligence) of the IPC.

They were also charged under Sections 337 (causing hurt by act endangering life or personal safety of others), 338 (causing grievous hurt by act endangering life or personal safety of others) read with section 36 (effect caused partly by act and partly by omission) of the IPC and Section 14 of the Cinematography Act.

Six other accused - Uphaar Director R M Puri, managers K L Malhotra, Radha Krishan Sharma, Nirmal Singh Chopra and Ajit Chowdhary and gatekeeper Manmohan Unniyal will face charges under Sections 304 (culpable homicide not amounting to murder) of the IPC besides the charges against the seven above mentioned accused.

The remaining three accused - DVB officials Brij Mohan Satija, A K Gera and Bir Singh - will face all the charges mentioned against the second set of accused except those under the Cinematography Act, 1952.
