Judicial custody for Gujarat Samachar owners

Vikram Vakil in Surat

Gujarat Samachar owners-editors Shreyans and Bahubali Shah were sent to judicial custody on Wednesday, in a defamation case. The brothers have been lodged in a sub-jail on Ring Road in Surat, Gujarat.

The six-edition Gujarat Samachar is the largest selling Gujarati newspaper in India, with a circulation of 900,000.

The Shah brothers were arrested in connection with a case filed by Niranjan Choksi, a Surat builder.

Choksi filed a case against Gujarat Samachar for publishing an advertisement, which he said had defamed him.

The case was filed in a Surat lower court which issued summons to the brothers.

Since the Shahs are residents of Ahmedabad, the summons was sent to them from the nearest police station. In this case, the Khanpur police station reported that Shreyans and Bahubali Shah were 'not available' and hence could not be served the summons.

Subsequently, the Surat court issued a warrant for the Shahs's arrest.

The brothers appeared in court on Wednesday.

Judge Tadvi heard their lawyer for about an hour-and-a-half and then announced he was adjourning the court. The hearing will continue on Thursday.

Shreyans and Bahubali Shah were then ordered to spend the night in custody.
