Top Bombay cop arrested in corruption case

The Anti-Corruption Bureau today arrested suspended Additional Commissioner of Police A K Jain for his alleged involvement in a Rs 210,000 bribery case after the Bombay high court rejected his anticipatory bail application.

Jain, a senior Indian Police Service officer, was arrested outside the court for custodial interrogation. Justice Vishnu Sahay rejected his bail plea saying the nature of offence was serious and if bail was granted, it would send wrong signals to the people.

Earlier, advocates Ramrao Adik and Majeed Memon told the court that Jain's custodial interrogation was unnecessary as he was always present at the ACB office over the last eight days and the police had had sufficient time to question him.

Memon, who argued the matter at length, said his client was implicated at the behest of some senior police officers who were jealous of him. It was pointed out that Jain's chartered accountant Prasanna C Lodha, who had allegedly accepted the bribe on his behalf, had in his statement to the ACB clearly said the transaction had nothing to do with Jain.

Memon told the court that in the first remand application when Lodha was sent to custody, the offence was registered against him alone and the "column details of known suspects and unknown accused with full particulars does not bear the name of Mr Jain".

The court was also told that the whole episode appears to be dubious and unbelievable primarily because Jain had no power to suspend the complainant, Inspector Sanjay Kokil. Such powers are vested only in the commissioner of police.

"The alleged marked notes were recovered from the accused Lodha and nothing is found from the petitioner. Even according to the prosecution the bribe money has never reached the petitioner nor [has] the petitioner [been] alleged to have shown any favour to Kokil or misused his office for any illegal purposes. Upon the complaint the trap was laid only against Lodha and not against Mr Jain," Memon said.
