HC throws out frivolous PIL against I-T dept

The Delhi high court on Wednesday issued a contempt notice and slapped a penalty of Rs 20,000 for frivolous litigation on Namit Verma, a resident of Madhya Pradesh, who alleged that income tax authorities did not properly investigate charges of profiting from match-fixing against cricketer Ajay Jadeja.

The contempt notice is returnable on September 20, a division bench of Chief Justice Arijit Pasayat and Justice D K Jain said.

Verma had approached the court with a public interest litigation, which said I-T authorities went to Khirki Extension in south Delhi to conduct searches under Section 132 of the Income Tax Act, 1961.

The officials acted on specific information which said five bags full of currency and valuables belonging to Jadeja were kept at the residence of Samata Party president Jaya Jaitley.

However, I-T authorities returned without conducting the search on July 20, Verma said. He also alleged that Jaitley pressurised Union Finance Minister Yashwant Sinha and his deputy Dhananjay Kumar to call off the raids.

The court dismissed the PIL on the ground that it was solely based on media reports, which do not constitute evidence in terms of law.
