Kerala HC dubs govt order on Nadars illegal

A division bench of the Kerala high court has ruled that clubbing of the Hindu Nadar community with Christian Nadars for reservations was unconstitutional.

The bench, headed by Chief Justice A V Sawant, declared in Kochi a government notification of December 13, 1978 as illegal and arbitrary.

The court, however, said that this order would have prospective operation and appointments made under the impugned notification would not be disturbed.

The judgement was issued on a petition filed by Hindu Nadar Corporation general secretary N K Bhasi, who submitted that the Hindu Nadar community was socially, economically and educationally backward from time immemorial, while Christian Nadars came under the CSI church.

The government contended that the backwardness of a community was determined not on the basis of religion but on its social, educational and economic conditions, which was also supported by a scientific study.
