Rukma Singh seeks custody of Aaliya Ilyasi

Television serial producer Suhaib Ilyasi's mother-in-law Rukma Singh on Tuesday moved the Delhi high court, seeking custody of his three-year-old daughter Aaliya.

The development came barely six week after Justice S K Mahajan had restrained Suhaib's in-laws from forcibly taking custody of Aaliya.

Rukma challenged the judge's order and approached a division bench comprising Justices Devinder Gupta and Mukul Mudgal. ''Aaliya is deeply and emotionally attached to her maternal grandmother who has been taking care of the child for almost two years,'' said advocate Ravinder Sethi.

The child's age is such that in the absence of her mother, it will be better if Aaliya is in the company of her maternal grandmother, he said, adding that Section 353 of the Mohamadan law prescribes the right of female child's custody with a maternal grandmother in the absence of a mother.

''Thus, in equity as well as in law, Rukma is entitled to Aaliya's custody,'' Sethi said.
