Former Uttar Pradesh chief minister Kalyan Singh on Thursday moved the Delhi high court for quashing of the bailable warrant issued against him by the Liberhan Commission probing the events leading to the demolition of a disputed structure (Babri masjid) at Ayodhya during his tenure in 1992.

Singh, whose counsel had given an undertaking to the Commission about the appearance of the former chief minister before it on Friday, questioned the panel's power to summon those people as witnesses who had been issued notices under Section 8B by the Allahabad high court.

Singh's petition is likely to come up for hearing before the high court on Friday. Singh, in his petition moved through advocate Ajay K Aggarwal, also said that he along with some others had challenged constitution of the commission in the Allahabad high court.

"Issuance of notices to call upon the petitioner (Singh) and others before the commission as witnesses would mean that they were being subjected to cross-examination," the petition said.

Justice M S Liberhan Commission, on July 27, had issued a bailable warrant against Singh after he failed to appear before it despite repeated summonses.
