Centre gets reprieve over CVC ordinance

The Supreme Court today declined to make any order on amicus curiae Anil Divan's submission that the recently promulgated ordinance, making the Central Vigilance Commission a ''statutory authority,'' was bad in law.

The challenge was made in the written submissions filed by Diwan in the pending proceedings of the multi-billion rupee Indian Bank scam case allegedly involving politicians, industrialists and bank officials.

However, a three-judge bench comprising Justices S P Bharucha, G T Nanavati and B N Kirpal gave the Union government two weeks to file its response to the challenge.

The time was sought by Solicitor General Santosh Hegde. The court fixed September 22 for hearing the matter.

Divan, in his submission, said that the impugned ordinance of August 25 is illegal, unconstitutional and subversive of rule of law as embodied in the directions given by the apex court in its judgment in the Jain hawala case.
