Judge slaps I-T dept wrists in Arjun Singh case

The Madhya Pradesh high court has set aside the notices issued by the income tax authorities to initiate proceedings for the revaluation of the cost of the Kerva bungalow near Bhopal, owned by Congress Working Committee member Arjun Singh, his wife and son.

The court also quashed other notices issued by the income tax department to them for reopening their income tax and wealth return filed for the year 1987-88.

While pronouncing the 95-page judgement, Justice D P S Chouhan yesterday allowed with cost the two separate petitions moved by Arjun Singh, his wife Saroj Singh and son Ajay Singh 'Rahul'.

All the three petitioners had challenged the separate notices issued by the income tax department for a fresh valuation of the cost of their Kerva bungalow as well as for reopening their income tax and wealth return for the assessment year 1987-88.

In its decision, the court also restrained the income tax authorities and all other officials under the provisions of the Income Tax and Wealth Tax Act, concerned with or authorised for, in the case, from proceeding or taking any steps or action against the petitioners with respect to the land and the Kerva, under provisions of the Income Tax and Wealth Tax Act.
