HC notice to Centre on divorce law

The Kerala high court Wednesday issued notice to the Union government on a writ petition seeking to declare section 10 of the Indian Divorce Act illegal.

Justice C S Rajan was admitting a petition from Danish Varghese of Aroor contending that the law discriminated in granting divorce to Christian men.

Under the section, a Christian, in order to get divorce, must prove his wife was guilty of adultery. But if a Christian woman desired divorce, there were more grounds like desertion, cruelty, insanity etc, he said.

This marriage law of other religions provide more grounds for husbands to seek divorce. This discrimination was arbitrary and contrary to the mandate of the Indian constitution, the petitioner contended.
