Karnataka-AP dispute over Krishna waters referred to Constitution Bench

The Supreme Court has referred to a five-judge Constitution Bench the two suits -- one by the state of Karnataka and the other by Andhra Pradesh -- relating to the contentious issue of sharing the Krishna river waters.

The Karnataka suit seeks the court's direction for implementation of 'Scheme B'' of the Bachawat award relating to the distribution of ''surplus waters'' of the Krishna river.

The suit by Andhra Pradesh is for restraining the state of Karnataka from increasing the height of the Alamatti dam from 519 frl to 524 frl.

The reference was made by a division bench comprising Chief Justice M M Punchhi and Justice K T Thomas in view of the fact that both the suits involved interpretation of Article 262 of the Constitution and Section 11 of the Inter-state Water Disputes Act, ousting the jurisdiction of the court.
