Radha Mohta and Laxmibai Newar -- two sisters of M P Birla -- would be filing affidavit opposing the probate petition of Rajendra Singh Lodha.
Legal sources said, both sisters were not willing give Lodha a free hand for obtaining probate of the will.
Birla vs Lodha: War over a will
Mohta and Newar had already filed caveats in the Calcutta high court against the probate filed by Lodha. Lodha challenged the authority of four Birla members, who filed caveats in the probate case but however there was no opposition to the caveats filed by the sisters of M P Birla.
The sisters have however been asked to issue citation relating to the will.
N G Khaitan, advocate on record of Birla group, confirmed that both the sisters have proposed to file affidavits objecting the granting of probate to Lodha, However, he refused make any further comments about the content of the affidavits.
Under Rule 25 of the Calcutta high court original side rules, an objection to the probate is to be filed within eight working days from the date of receipt of notice.
It is also learnt from the legal sources that both sisters in their affidavits contemplating to come down heavily against the attempt of Lodha to obtain probate, depriving them.
Sources said that in the affidavits, they stated that it was unbelievable that an outsider of Birla family was entrusted to enjoy their brother's empire.
The sisters also indicated their doubt about the authenticity of the will.
