Former IPL chairman Lalit Modi has asked for details of the recently held Special General Body meeting of the Cricket Board and the decisions it took in order to prepare his defence in front of the BCCI's disciplinary committee.
Modi's counsel Gaurav Gopal of Wadia Ghandy & Co., had asked the Board to provide them with a copy of the SGM's notice and agenda, attendance sheet, minutes of the meeting and resolutions passed and any other relevant document.
A release from Modi's general counsel Mehmood Abdi said today that these issues were being raised following media reports about the SGM and the decisions that it took.
The Modi camp has asked for all the relevant documents relating to the decisions taken by the Board at its SGM to be given to it within the next 48 hours, the release said.
The SGM was convened by BCCI on December 11 following the technical objection raised by Abdi on November 23 that the three-member panel conducting the probe against the former IPL chairman did not have the mandate from the Board's General Body that met on September 29.
Though the Board did not issue any official media release, sources who attended the SGM revealed that the same three-member disciplinary panel -- Chirayu Amin, Arun Jaitley and Jyotiraditya Scindia -- was retained to continue the proceedings against Modi who is accused of financial irregularities in the conduct of IPL.
The next sitting of the disciplinary panel probing the charges against Modi has been fixed for December 27 and 28, the release from Abdi said.
"That the application filed by us bringing to the notice of the DC (Disciplinary Committee) its inherent lack of jurisdiction was to be heard and a decision had to be taken by the Committee on 13th and 14th of December, 2010 but due to unavoidable and unfortunate circumstances the hearing had to be postponed to 27th and 28th of December, 2010," said Abdi in his release.
The unfortunate circumstance Abdi referred to was the road accident involving Modi's counsel Swadeep Hora when he was returning to Jaipur from Delhi last Friday.
The Modi camp had asked for postponement of the meeting by informing disciplinary panel member Jaitley that Hora's son was injured in the accident and the counsel cannot conduct the cross examination on December 13 and 14 as he needed to take care of his son.
BCCI acceded to the request and the meeting was put off to the end of this month.
