Stay on BCCI proceedings against Modi continues

The Bombay High Court on Thursday continued the stay granted on the proceedings of the Board of Control for Cricket in India's Disciplinary Committee, which is probing alleged financial irregularities by former Indian Premier League commissioner Lalit Modi, till January 13.

Lawyers of the BCCI and Modi made brief submissions but sought time to seek instructions from their clients as the matter involves legal issues.

Accordingly, Justice S J Kathawala deferred the matter till January 13 and continued the stay on proceedings till then.

Modi has filed a civil suit seeking confirmation of the stay on the proceedings of the disciplinary committee's meeting. He has challenged the very existence of the committee after its term expired on September 29 last year. He also questioned the validity of the proceedings undertaken by the present committee.

Modi contended that under article 1(q) of the bylaws, the BCCI is authorised to have just one disciplinary committee for a term of one year. The committee's term expired when the BCCI failed to re-appoint it on September 29, his suit says.

Instead, the BCCI formed two disciplinary committees – one headed by Arun Jaitley and another by board president Shashank Manohar. The Jaitley committee has no fixed term. The Manohar committee is formed under article 1(q) for a year.

This is violative of 1(q) of BCCI bylaws, which provides for just one

Disciplinary committee and that too for a fixed period of one year, Modi pleaded.
