The Supreme Court, on Tuesday, cleared the deck for holding the adjourned AGM of Board of Control for Cricket in India at Kolkata before November 30 as disputing parties to the elections mutually arrived at consensus on six-point terms and reference for former Chief Election Commissioner T S Krishnamurthy, who will be the observer for the elections.
Taking on record the draft notes of the discussion on which the warring factions agreed, a Bench comprising Justice B P Singh, Justice S B Sinha and Justice P K Balasubramanyan said that after the elections the observer would send his report with brief reasons for his ruling on voting rights and on elegibility/disqualification to the apex court within a week, and posted the matter for further orders on December 12.
The draft notes submitted to the court did not touch on the contentious issue as to which Cricket Boards among Bihar and Jharkhand had the right to vote.
Senior advocates K K Venugopal and Soli Sorabjee, appearing for the BCCI and senior advocate Harish Salve on behalf of Netaji Cricket Club, Chennai and State Cricket Associations of Rajasthan and Bihar, appraised the Bench about the consensus reached.
At the outset, they said that former CEC had agreed to act as an observer but the parties took time to arrive at consensus for continuing with the adjourned AGM at Kolkata.
It was on the intervention of the Bench the clause for holding the AGM at Kolkata was added as the NCC and the two state cricket associations had expressed their reluctance for the venue.
