No attempt to kill BJP leaders: SC

Supreme Court on Tuesday dismissed Gujarat government's petition challenging the high court order discharging 11 persons charged with a conspiracy to eliminate Bharatiya Janata Party president Lal Kishenchand Advani, Chief Minister Narendra Modi and Vishwa Hindu Parishad leader Pravin Togadia.

A bench comprising Justice H K Sema and Justice B N Srikrishna upheld the Gujarat high order discharging the accused persons.

It also concurred with the high court order that the confessional statement of the accused were not admissible under law.

Advocate Mukesh Giri, appearing for the two accused, opposed the special leave petition of the Gujarat government against the April 2, 2004 order.

The accused were booked under various sections of Indian Penal Code including conspiracy to wage war against the state and under the provisions of the Passport Act.

Prosecution had alleged that the accused were members of Pakistan-based militant outfit Jaish-e-Mohammed.

One of them, Samir Khan, was killed in an encounter with the police on September 30, 2002.
