The Supreme Court on Monday set aside a Delhi high court order quashing the charge sheet against three Hinduja brothers in the Rs 640 million Bofors payoff case following an appeal by the CBI.

The high court had quashed the charge sheet on the ground that the investigating agency had not taken prior permission of the Central Vigilance Commission (CVC) before filing the charges.

Setting aside the high court order, a SC bench comprising Justice S Rajendra Babu and Justice G P Mathur termed it as 'self contradictory and confusing'.

The apex court also allowed an appeal filed by the CVC challenging the high court order.

The court had earlier reserved its verdict after hearing Solicitor General Kirit Raval argue the CBI's case while senior advocate Ram Jethmalani represented the Hindujas.
