Mumbai

The Bombay High Court Friday quashed the percentile system adopted by the Maharashtra government for admitting students in class XI saying it was "flawed and not based on factual data".

Justice J N Patel concurred with the earlier judgement by Chief Justice Swatanter Kumar. A petition filed by one Fransisco Luis, who challenged the percentile system, was originally heard by the division bench of Chief Justice Kumar and Justice A P Deshpande. But while Justice Deshpande upheld the system, Chief Justice Kumar had struck it down. The case was then referred to a third judge, Justice Patel.

Today, Justice Patel gave his ruling saying the percentile system was flawed and was not based on factual data. Patel said that before adopting the system, which had sought to 'normalise' marks obtained by students of various boards, CBSE and ICSE Boards were not heard.
