Rizwanur Rehman's family on Thursday moved the Calcutta High Court, challenging the West Bengal government-appointed inquiry commission headed by a retired judge to look into the youth's mysterious death.

With the high court already ordering a probe by the Central Bureau of Investigation, there is no point in continuing with the Justice (retired) Aloke Chakraborty Commission of Inquiry, the petitioners -- Rehman's mother Keshwar Jahan and his elder brother Rukbanur -- said.

Their counsel Kalyan Banerjee said that the mysterious death of the graphic designer was now being investigated by a probe agency and there was no point in conducting an inquiry by a retired high court judge.

Moreover, the inquiry commission has no right to question IPS officials who are appointed by the Centre, Banerjee contended.

He said the matter is likely to come up before a vacation bench on November 1.

Rizwanur married Priyanka Todi under the Special Marriage Act on August 18 and lived with her at his residence from August 21.

The couple was summoned to Lalbazar, the Kolkata Police's headquarters, thrice. Priyanka returned to her father's home on the third occasion on September 8 following a written assurance by her uncle that she could return to her in-laws after a week.

However, she never came back and Rizwanur failed to trace her or contact her. His body was found on railway tracks near Dum Dum on September 21.

Public outrage after his mysterious death had forced the state government to order a judicial inquiry into Rizwanur's death and transfer five senior police officials, including the Kolkata Police Commissioner.
