Jaya Bachchan disqualification first of its kind

Disqualification of Jaya Bachchan as member of Parliament with retrospective effect is the first of its kind and Rajya Sabha officials are wondering how to go about implementing it.

When asked whether Bachchan would be asked to return the salary and allowances she received as a MP and her speeches would be expunged from the records, Rajya Sabha Secretary Gneral Yogendra Narain said, "We will have to study the order in detail before taking any decision on it."

He said it was for the first time a member has been disqualified with retrospective effect and the order would have to be studied in detail before putting it before the Rajya Sabha chairman for orders.

For deciding on the issue precedents in the state legislatures would be looked at if there are any, Narain said.

In the past only one member of Rajya Sabha has been disqualified for holding office of profit.

Late R Mohanrangam of All India Anna Dravida Munnetra Kazhagam, who was disqualified in 1982 for holding the office of special representative of Tamil Nadu government in Delhi, was disqualified from the day of passing of orders.

Bachchan had become member of Rajya Sabha on July 4, 2004, and accepted the post of chairperson of Uttar Pradesh Film Development Corporation on July 14, 2004. As she was a member for 10 days, Bachchan can claim the benefits of former MP.
