Delhi Police to challenge Geelani's acquittal

The Delhi Police has decided to challenge the acquittal of S A R Geelani and Afsan Guru alias Navjot Sandhu in the Parliament attack case.

The Delhi high court last week, while acquitting Geelani and Sandhi, had upheld the death sentence of Shaukat Guru and Mohammad Afzal.

A senior Delhi Police officer told rediff.com that they are in the in the process of drafting an appeal against the court order. He said the appeal will be filed next week in Supreme Court.

"We in Delhi Police feel that the acquittal of both the accused persons was wrong," he said.

Lt Governor Vijai Kapur has granted permission to file the Special Leave Petition in the Supreme Court.

"We have carefully gone through the judgment of the high court and we are convinced that we have a case that the honourable Supreme Court would uphold. We have a strong case against Geelani and Afsan Guru," the officer said.

But Geelani's advocate Kamini Jaiswal said the Delhi Police have no grounds to move the Supreme Court against her client.

"I don't know on what grounds they can move the apex court. If we look at the whole case both legally and morally there is no case against my client and the honourable high court has rightly acquitted Geelani of the charges. He was sentenced to death by the lower court despite the fact that there was no case made out against him," she said.
