COAI questions tribunal's WLL verdict

The cellular operators on Wednesday criticised the majority judgement of the Telecom Dispute Settlement and Appellate Tribunal, which had permitted the wireless in local loop services, saying there was no reason given by the two judges to justify their views which were contrary to those of the TDSAT chairman.

"In our view, there is no proper reasoning in the judgement of the majority to justify they are taking a view contrary to Justice Wadhwa's findings," Cellular Operators Association of India said in a letter to the Telecom Commission chairman Vinod Vaish.

The COAI, however, has sought an immediate implementation of the majority verdict by the department of telecom to ensure that no further damage was caused to the cellular industry and its investments.

Last week, the TDSAT had given a majority judgement permitting WLL services and had also prescribed steps for ensuring a level playing field between the cellular and WLL service providers.

While Justice D P Wadhwa, who is also the chairperson of TDSAT, had given a dissenting judgement dubbing WLL services as illegal, the other two judges, R U S Prasad and P R Dasgupta had ruled in favour of WLL services.

The areas of immediate enforcement include restricting WLL handsets within the SDCA (local call area) in which it is registered besides restricting WLL operators from using mobile switching centres equipments in their networks to ensure that mobility was limited.
