Dr Reddy's loses case against Eli Lily

Dr Reddy's Laboratories on Friday announced that the United States District Court for the Southern District of Indiana while upholding the patent rights of Eli Lilly relating to Zyprexar has ruled that DRL has infringed the laws.

Stating that the company would challenge the court ruling, G V Prasad, CEO of Dr Reddy's Lab, said, "We are disappointed by the court decision and will appeal this decision to the Federal Circuit.

"Despite today's adverse ruling, our strategy remains unchanged and we continue to make consistent progress towards building a sustainable generics business in the US."

In May 2001, Eli Lily had filed a case against Dr Reddy's Lab alleging patent infringement on the '382 compound patent' listed on the Orange Book. The trial was completed in April 2004.

As of December 31, 2004, thirty-nine ANDAs (abbreviated new drug applications) from the DRL stable are pending approval from the US Food and Drug Administration.
