"As the issue of mobility has implications with respect to applicability of ADC, the Authority directs you to strictly ensure that the terminal used for fixed wireless services is strictly confined to the premises of the subscriber", TRAI said.
It should also be noted it is the licensee's responsibility to ensure that the subscriber terminal is operated in accordance with the terms of the licence for fixed lines, the regulator said.
All access providers should also ensure there are no misleading advertisements in the electronic and print media, it added.
TRAI said it has come to the notice of the Authority that new terminals being deployed by access providers do not have any fixed network access point physically located at the address of the subscriber.
"In this regard, certain complaints including those of misleading advertisements, have been received by the authority and subsequently show cause notices issued to the concerned operators. The responses given by the service providers were not found to be in order," the regulator said.
TRAI's directive comes after it had issued an order to Tata Televentures, Reliance Infocomm, BSNL and MTNL for withdrawing the related advertisements for positioning their fixed wireless phones as mobile phones but at the same time avoiding payment of ADC.
Tatas have positioned their fixed wireless phone 'Walky' as 'Freedom of Mobility at Landline Rates', Reliance calls the service 'Unlimited Cordless' while MTNL's Garuda fixed wireless is called 'Mobile bhi landline bhi'.
Tata Teleservices, in fact, had challenged the order of TRAI in the tribunal TDSAT. However, TDSAT dismissed TRAI's order and instead asked the regulator to send fresh notices to these companies seeking an explanation.
