Tamil Nadu speaker to move court against Jain reportTamil Nadu assembly Speaker P T R Palanivel Rajan proposes to move the Madras high court in his individual capacity, seeking to expunge the 'defamatory' remarks against Tamil people in the Jain Commission report if a debate was not initiated in Parliament. He said that as speaker he was empowered to take up the issue before the Privileges Committee under rule 226. Launching a broadside against Justice M C Jain, the speaker said the 'leakage' tantamounted to contempt of Parliament. Justice Jain, in Rajan's opinion, should have waited for the designated court's judgment on January 28 before submitting his report. He said to redeem the honour and dignity of the Tamilians, he might also request the Centre to wind up the Jain inquiry. "It has harmed national integration," he said. The Commission has not examined the special team which investigated the case and filed the chargesheet against 41 accused. "This amounts to judicial misconduct and dishonesty," Rajan charged. The speaker said the Centre could be requested to reject the interim report as invalid, incomplete and perfunctionary. Legal advice could also be sought to initiate action against Justice Jain under section 153-a of the Indian Penal Code. "A motion of privilege can be moved against him for contempt of Parliament if the leakage is traced to him," he added. Commission Secretary D R Luthra's denial of any leakage was 'totally unacceptable,' Rajan said. UNI |
