Delhi high court stays proceedings against Jains in hawala case

The Delhi high court on Friday stayed trial court proceedings against the Jain brothers in the case relating to late Union minister A K Sen in the Rs 650 million Jain hawala case. It also issued notice for July 26 to the Central Bureau of Investigation in the matter.

Justice Mohammad Shamim passed the orders following a petition moved by accused B R Jain, S K Jain, J K Jain and N K Jain, seeking the quashing of charges of criminal conspiracy and corruption framed against them by special hawala judge V B Gupta on April 8.

Gupta had framed the charges under section 12 of the Prevention of Corruption Act for allegedly bribing Sen with Rs 2 million between December 1990 and January 1991, when he was the Union minister for steel and mines. Sen died on August 31 last year.

According to the CBI, Sen had helped the Jains secure several contracts of the Bhilai, Durgapur and Rourkela steel plants.

Counsel for the Jains, Kapil Sibal, said the CBI had not brought on record any other material, in the form of documents or witnesses' statements, to support its chargesheet and had made charges only because Sen's name was present in the Jain diaries.

As per the high court ruling last month in the L K Advani and V C Shukla cases, the accused should be discharged in this case as there was no material other than the Jain diaries which were no evidence.
